Dear FOOTDISTRICT Customer Service,
Thank you for your reply.
I understand that you are investigating the situation with UPS. However, I do not believe it is reasonable for me to continue waiting indefinitely for an internal investigation between FOOTDISTRICT and UPS.
I returned the package using the return procedure provided to me, and UPS accepted the parcel. I have therefore fulfilled my obligation to return the goods and I have proof that the parcel was handed over to the carrier.
Under EU consumer law, a trader may withhold a refund only until the goods have been received back or until the consumer provides evidence that the goods have been sent back, whichever occurs first. I have provided evidence that the return shipment was handed over to UPS.
The fact that the parcel subsequently appears to have been lost while in the carrier's network is not something I can control. I therefore ask FOOTDISTRICT to process my refund without further delay and to resolve any claim with UPS directly.
Please confirm that my refund will now be processed and provide me with the expected refund date.
If you refuse to issue the refund, please provide me with the specific legal basis for your refusal and explain why you consider me responsible for the loss of a return shipment after it was accepted by UPS.
