More than 30 days passed since the order date, yet the merchant still failed to provide verified proof of delivery.
The provided DHL POD contained no recipient name, no identification details, and only an unreadable signature. DHL and the merchant were unable to confirm:
- who collected the parcel,
- whether the mandatory PIN verification was performed,
- or whether any ID check took place.
Instead of proving delivery, the merchant repeatedly demanded that I file a police report before any refund or resolution could proceed, while refusing to explain the legal basis for withholding my money despite the absence of verified delivery.
DHL itself confirmed that the matter remained “under investigation” and that recipient identity still had to be verified through CCTV review.
In my opinion, this is an unacceptable attempt to shift responsibility for a failed delivery process onto the consumer, even though the merchant remains legally responsible for delivery and reimbursement when delivery cannot be proven.
Due to the handling of this case, complaints are now being submitted to FPS Economy and ECC Belgium, the matter has already been escalated to the Belgian postal ombudsman service, and a chargeback procedure with the bank is being initiated.

Formal Escalation – Failed Delivery (order: W3686776 ) and Refusal of Refund
I am updating my review because the situation has become even more concerning.
This parcel was sent using a DHL Express PIN-controlled collection process. However, the merchant later confirmed in writing that:
* the parcel was released without the PIN being used,
* no identification was checked,
* the parcel was handed over based on a name only,
* and the delivery could not be considered complete.
Despite these serious procedural failures, the company repeatedly attempted to make a police report a condition for a refund.
However, DHL has now officially confirmed directly to me that:
“Your shipment can’t be located.”
DHL also instructed me to contact the shipper regarding a refund/replacement and did not mention any police report requirement at all.
Despite this, the company continues attempting to delay resolution and continues referring to “ongoing investigations” even after DHL confirmed the shipment cannot be located.
More than 30 days have passed since the order date and the goods were never delivered to me.
Under EU consumer law, the seller remains responsible until the goods are physically delivered to the consumer. In this case:
* the PIN-controlled delivery procedure failed,
* the parcel cannot be located,
* and the company continues withholding the refund.
At this stage, the matter has already been escalated to:
* the Belgian Consumer Mediation Service,
* the Belgian Postal Ombudsman,
* and the Belgian FPS Economy Economic Inspection services.
If necessary, I will also proceed through my bank via chargeback and pursue further legal remedies.
Very disappointing handling of consumer rights and delivery responsibility.
