Lyte Ladders and Towers Limited misrepresented delivery status and failed to fulfil a consumer contract.
A “new” ladder (£99.30) was marked as shipped and later claimed to have been “refused”, despite no courier attending my address and no refusal by me. The seller then asked whether I wanted a credit, while no goods had been delivered and no refund had been processed.
This conduct breaches the Consumer Rights Act 2015 (failure to deliver goods as contracted) and the Consumer Protection from Unfair Trading Regulations 2008 (misleading actions and false delivery claims). Delivery records were contradictory and no proof of attendance or delivery was provided.
Funds were retained while responsibility was repeatedly shifted to the customer. This is not a simple courier delay but systemic misreporting of order status. Customers should proceed with caution and keep full records.
Additional context:
Before this B&Q Marketplace order, a delivery connected to same seller network and courier) arrived with the wrong ladder, which was clearly used and damaged despite being sold as new. I lawfully refused that delivery. The refund was delayed and only resolved after escalation. This earlier failure appears to be directly linked to the later confusion, with refusals and delivery statuses being wrongly attributed instead of properly correcting stock and fulfilment.
