This is the second time I’ve bought a…

This is the second time I’ve bought a product from the Mac guys and once again I’m impressed by the quality of their products and the quality of their customer service. I ordered a phone and then was informed it didn’t pass their quality checks so I would either have to get a full refund or if I wanted another phone I could get it for a cheaper price. I chose the latter and my phone was ready with 30 minutes and a case thrown in for free. Also have a 2015 Mac Book air from the Mac guys that I’m still very happy with after a few months of use. Would recommend anyone wanting to get refurbished Mac products to choose the Mac guys.

Good for refurbished

Laptop arrived with a broken keyboard but they were very quick to repair and were also very responsive throughout the whole process :)
Laptop itself also is a little scuffed up + the corner is a little bent but for a refurbished product is it pretty good

Violation of Consumer Laws

The multiple violation of consumer laws in breach by The Mac Guys (TMG) has been reported and is being investigation by the Australian Competition and Consumer Commission.

I purchased a Brand New iPhone 12 Pro Max from TMG in June 2021. Prior to making this purchase, I called to check that the phone is indeed brand new and that it carried the manufacturer’s 12-month warranty from purchase date—this was confirmed by TMG.

Violation 1: Listing Lacking Information. When the phone arrived, the Brand New phone did not come sealed in its original box, but instead, in TMG box. This was not mentioned anywhere in the listing.

Violation 2: Misinformed Warranty. Checking the phone’s serial number against the Apple warranty, the phone was activated in Nov 2020, and had only 5months of Apple warranty left. I was misinformed by TMG.

I contacted TMG immediately to try to resolve the issue, stating that the advertising was misleading and that I was misinformed. I had expressed my concerns that as the phone is opened from its original box, and activated 7 months ago, it is impossible to guarantee its Brand New condition. I requested for the phone to be returned, TMG advertises Free Returns in the homepage.

Violation 3: Misleading Listing. The Mac Guys vehemently denied any misinformation and misleading listing. They claimed that “Brand New Condition” does not equate to “Brand New Sealed”, and the “Brand New Condition” only refers to its cosmetic condition. They assured that the phone has not been used and has been priced accordingly to reflect this.

Violation 4: Lacking Information. There is no point of reference or comparison between “Brand New Condition” and “Brand New Sealed” anywhere in their website. This does not allow consumers to make an informed decision with their purchase.

Violation 5: Misleading Pricing Strategy. TMG infers that the “condition” of the phone is self-informed in its pricing. TMG claims that the phone is priced $150 below RRP. However, TMG advertised a discounted price of $1599 Save $300 (Original Price $1899), which misleads the customer into thinking that they are getting the phone below its usual price, and the customer assumes that the phone is brand new which is reflected in its original price.

Violation 6: Contradictory Return Terms. TMG has refused to accept the return for free, insisting to charge 15% as Restocking Fee. When questioned about their Free Returns policy, TMG claims that this does not apply to Change of Mind. This is not listed in their Terms of Sale. Note I am returning based on “Not as Advertised”, and not "Change of Mind". TMG insists that since the phone has been “activated”, the phone is no longer in its “Brand New Condition” and therefore the restocking fee applies. I had informed them that I had not used the phone, and only checked its serial number. Paradoxically, it is through checking its serial number that I had found out that the phone was activated 7 months prior. TMG had contradicted their own terms.

In compensation, TMG offered The Mac Guys 12 month warranty to make up for the misinformed 12 month Apple warranty. I did not accepted this offer.

The phone is currently still in its box, unused, and is still deemed in “Brand New Condition” until the investigation and resolution is achieved.
Unfortunately, my 1-star rating is how the events on the after-sales customer service transpired. I would have given them a 5-star rating should they have admitted their errors and fully refunded my returns.

On the points you raised in your review,
we stand by our original communication to you that the phone has never been used.
This device was a replacement unit by the manufacturer, and never used.
The manufacturer warranty starts from the original date of purchase, not from the date of activation of the replacement unit.

We are very stringent with our cosmetic grading, hence the brand new condition for this cosmetic grading.
Every device we receive is fully inspected and hence we are required to unbox devices for cosmetic grading assessment.
We understand that you have concerns about the phone being used or tampered with previously.
We advised you to have apple check the device; should the device have been tampered with, we would have not hesitated to refund you fully.

Our pricing is based on multiple factors, with cosmetic grading being one of them. Your purchase was below the RRP, to which you also applied a discount code, further lowering the total cost.

We feel like we went above and beyond our premium service in this instance, bundling a brand new 20W Apple fast charger, which is usually not included with brand new iPhone 12 pro max.
We are confident in the quality of the product, hence our offer of extended warranty at no extra cost.

We understand that you are looking for a return for full refund.
As per the Australian Consumer Laws, the device is eligible for refund in cases of major faults, which is not the case here.
As such, we are required to apply a 15% restocking fee to cover costs and decline in value, which is outlined in the T&C's on our website.
