Originally the partners of A E Smith & Son were to act as Executors, but in the intervening years the firm became part of WSP. The fee-earning solicitor and Executors are all Directors with 20+ years experience. My dealings with them spanned around 2.5 years with the above concerning Probate and a further year dealing with their Practice Manager and ICO trying to obtain my personal data. I was last in contact with them yesterday regarding a Data Security breach
Initially I felt confident in WSP due to their Law Society accreditation and happy at their involvement, but misgivings arose around communication and Estate administration, including excessive delays with property registration and misplaced documentation. A complaint was internally investigated without independent external adjudication by an outside source. WSP denied most issues but as 'a goodwill gesture' waived property registration charges.
A request for some basic information was ignored for months and then over another month and two letters for the Fee-earner to reply to my solicitor. Towards the end of the Estate administration I requested answers to pertinent financial questions - these went unaddressed for 3 months, until I contacted the Executors, but found the reply inadequate. Everything seemed to meander at a leisurely pace throughout eg taking a year after the property sale for monies to be paid out to beneficiaries.
An independent legal advisor reviewed all documentation and counselled we contact the Executors with our concerns ie inequitable dealings with beneficiaries, failure to manage and secure the house and contents; no schedule of the deceased’s personal assets drawn up or valuations made; lack of expert dispute resolution; lack of fair and equal distribution of sentimental items, being advised to accept a lower price for the family home without the Fee-earner having sight of the survey, to name but a few. WSP denied these.
Finances were problematic. We gained the impression the bill would be settled after winding up the Estate, but the deceased's bank account was cleared early on and taken by the solicitor to pay her fees in advance, rendering the Estate unable to pay even Council Tax or buildings Insurance on the house.
There were 3 fee hikes - the last was cleared immediately with the Executors but the Fee-earner admitted she had neglected to inform the beneficiaries of this Change in Terms for 9 months. We had concerns over a payment of £7k to a beneficiary but neither the Executors or Fee-earner would commit to saying they had seen proof that the monies were definitely owed/not a gift/had been paid by the claimant. Someone used the deceased's bank card for 6 weeks and this was also not explained to our satisfaction. The final bill was £18k - triple the original £6k estimate.
We requested the Fee-earner attend the family home to aid in the equal distribution of items but she refused on the grounds of 'cost.' Later she ordered some beneficiaries could only visit for the final time if a WSP representative was present (no reason was given). I was told it would not be a solicitor and as a 'goodwill gesture' no charge would be made. In the final accounts there was a £700+ charge for the time of a solicitor to attend, plus his travel expenses.
Private written concerns were disseminated to third parties without our prior knowledge or consent. I made clear to WSP that this and the threat of raising costs further made us feel that we were being coerced into signing off accounts that we had doubts about. The ICO deemed this an acceptable means to ‘conclude the administration of the Estate’ but it seemed to me a direct contradiction of SRA client confidentiality guidelines. I believe nobody should feel coerced into signing a legally binding document.
Further, when I applied for my data, some was in an inaccessible format and WSP told me to use Adobe Acrobat Reader; when this was done, it was possible to see through redactions, thus revealing other’s private information.
I assumed that professional Executors had a responsibility to all beneficiaries to ensure Estate administration is carried out efficiently and humanely to ease at least some of the stress after bereavement, but I did not feel this happened in our case. Maybe things might have been better if WSP had been appointed only in an advisory capacity rather than as Sole Executors so that beneficiaries could go elsewhere if unhappy with their performance.
I found it a traumatic and shattering experience and I would now have misgivings about leaving any solicitor's firm to act as Sole Executors of an Estate.
