Incompetent, dishonest and not fit for purpose.

Incompetent, dishonest and not fit for purpose.
They made no reference to anything I had submitted in their defence of BA. Please remember that CEDR is funded by the company you're complaining about. Case number: 681165

CEDR rejected my case on the basis that "The company provided convincing evidence that the customer missed the BA296 from ORD to LHR" which was completely and utterly false. The journey I made was from Tampa to Chicago, then a connecting flight from Chicago to London Heathrow (this second flight is what I was in dispute with BA about). I was on the specified flight from Tampa to Chicago to make my originally planned connection. However, I was given boarding passes for (the wrong flight) AA46, which should have departed earlier than BA296 - the flight British Airways didn't put me on. So there was no way I could have been late or missed that flight. In the end, the AA46 flight was delayed by over 5 hours.

I provided evidence that I was supposed to be on BA296, again the adjudicator had decided the outcome from the point above and said this was untrue. This was clearly to help them maintain their biased argument.

BA/AA didn't give me a boarding pass for BA296 even though I was booked on it. I don't know how I was supposed to get back without taking the AA46 flight. It's an offence to board a plane without a boarding pass, and I'm not sure how I'm supposed to get past the gate?

I'm completely baffled by the adjudicator's conclusion and can only assume that they haven't read the case properly, doesn't understand the merits of the case and is biased in favour of the airline. To make completely inaccurate allegations to dismiss the case on these grounds has broken any trust or confidence in CEDR to deal properly with people's cases. I hope that in future this adjudicator won't show the same level of malice towards other complainants and allow airlines to get away with bad behaviour.

Also, when I inquired about making a formal complaint - guess what - there was none.

Dear Matthew,

Thank you for taking the time to leave a review and for providing your case reference number.

Having read the decision in this case, the issues you have stated in your review were not ultimately the reason for your claim not being successful. As this is a public forum, I will not share further details here. If you would like further clarification on the adjudicator’s decision, please can I ask that you contact ‘complaints@cedr.com’ and we can do that for you.

Finally, CEDR does have a published complaints procedure. Here is a link for you: https://www.cedr.com/wp-content/uploads/2024/01/Aviation-Complaint-review-process-Jan-24.pdf

It is quite obvious that CEDR work for the companies. The only evidence referenced in their response was from the company. We were offered £500 by the company initially as they knew they had made mistakes. I wish I had just taken it now as we are now left with nothing after our roof has been relayed and drive dug up twice!! Absolute waste of hours of time and huge amounts of financial and emotional stress. None of which was considered by cedr.

Dear Kim,

Thank you for taking the time to leave a review. I am sorry to hear that this matter has been stressful for you and that you weren’t able to achieve the outcome you would have liked.

I am unable to identify your case from the information contained in your review and so I am unsure of which particular scheme you used. However, our adjudicators do consider claims for inconvenience and distress. Like all areas of a complaint, this must be considered within the scope of the scheme rules and be supported by evidence.

CEDR do not work for either party to a dispute. CEDR is an independent dispute resolution provider. Our independence and professionalism are subject to oversight and approval by UK Government appointed Competent Authorities namely the Chartered Trading Standards Institute, the Civil Aviation Authority, the Gambling Commission and Ofcom.

They've been dealing with a case with pop Telecom and me and according to them it's okay for pop Telecom to increase my bill by 48% and ignore all contact with me so they would not give me a refund zen pop Telecom cut my Wi-fi service and according to them that is fine there will be more to come after I've finished in court I will give you the proper judges decision

I am sorry to hear that you are not satisfied with the outcome of your case. As you have indicated, if customers are not satisfied with the Decision issued by the Adjudicator, they are free to reject it and use an alternative forum, such as small claims court, to continue their complaint.

Forget CEDR. Go straight to the Small Claims Court!

CEDR are flawed and even the mobile networks know this. Hence why everyone accept Vodafone use the Communication Ombudsman now as there ARD. CEDR Agent has made numerous mistakes in my case, they have agreed and the evidence all points to this. However as a ARD ironically they have no process in place to resolve mistakes made by their agents. I am now out of pocket because of their mistakes. These ARD's are not regulated, they can get away with whatever they want, does that sound like a fair impartial service to you!

PLEASE DONT WASTE YOUR TIME!

I first dealt with CEDR back in the July of 2022.

Long story short, my father in law who has dementia, was sold a Sky package. He was told at the time for him to have TV and Telephone service, it would be cheaper to get basic as well as this was actually cheaper than the two separately.

Fast forward, Sky billed him as agreed, but then decided to add Superfast Broadband at an additional £30 a month. When I complained to Sky, they refused to amend the bill, and subsequently went directly to a man they knew had dementia and gave him £200. Far less than owed.

After getting CEDR involved, they found nothing wrong with this arrangement. They also provided me with the wrong dates to submit my final appeal. When I did, they said they had made their final decision and my entire defence these “comments would not have amended the published decision in any way.”

I have found out today that he has still be paying for Superfast Broadband even though he has never received any equipment from Sky!

Way to go CEDR 🙌🏻 unsurprisingly you are funded by the likes of Sky! Now I will actually take it to court to get some real unbiased resolution.

*I would urge anyone not to consider using you absolute monkeys! Hence your atrocious score here!!*

The majority of our consumer schemes are funded by the companies who subscribe to our services. Almost every dispute resolution service in the UK is funded entirely by the companies that subscribe to them, either voluntarily or because it is a legal requirement to do so. The alternative would be that consumers would have to pay for the service or there would be no service at all. What can I say…

What can I say. CEDR were given their allotted timeframe to respond (20 days) on the last day they sent a note stating they can not do anything without my authorisation to allow my husband to go ahead with the claim on my behalf. In my opinion it was an excuse to gain a further 7 days only to come back and tell us that we have no solid evidence. This issue was in relation to our conservatory which is 8 years old. We moved in, in May and the rain comes in through the roof. They had the audacity to suggest that as they could see no water damage to the floor we must not be telling the truth. The floor is stone!!! Despite the hard photo evidence and multiple quotes from legitimate contractors stating the conservatory was not fit for purpose. They close the complaint. Even taking an additional unnecessary 6 days. I am completely outraged by the whole situation. I know also they won’t even read this. They will only respond to the 5 star reviews but it’s good to get it off my chest.

Dear Laura,

Thank you for taking the time to leave a review. I am sorry to hear that you are not satisfied with how your case has been handled. This is certainly not the experience we aim for.

Timeframes are set out in the scheme rules and CEDR does everything possible to ensure that these timelines are met. There are occasions where timeframes may need to be extended and the scheme rules allow for this. In the example you have provided, it appears that a response was provided within the timeframe that was specified.

Having looked at your case, I can see that it has not been closed by CEDR. The adjudicator appointed to this matter has issued a proposed decision and both parties have until 20th December 2024 to comment on this before a Final Decision is issued. If you require any further clarification on this stage of the process, please do reach out to the team and they will be happy to assist.

We welcome feedback from those who have used our services and do our best to reply to every review that is left, regardless of the score that has been provided.

We thoroughly review all cases that are accepted on to our schemes. Before making a final decision, our Adjudicators weigh up the evidence provided by both sides and make a decision based on the facts and any applicable laws and scheme rules. In your case, I can see that a 4 page Decision was issued by the Adjudicator outlining the reasons for the outcome.

Not every complaint that is submitted to us will result in the outcome that the customer would have liked. However, the majority of customers who bring their complaints to CEDR do have a favourable outcome. We are required to publish data relating to these outcomes. Impressed with simplicity of process

Although it took time & patience for CEDR to resolve BA intransigence over an admittedly complex delay compensation - they finally achieved full compensation.
The whole process was far less stressful than a Court claim, so I judge it as preferable process - plus far more economical !

Terrible at resolving disputes

What a complete waste of time. They do nothing but delay reaching a decision and bend over backwards to support the airline company even when its clear that compensation is due as a result of cancelled/delayed flights. Dont bother with these charlatans and take the airline to the small claims court instead for a swifter resolution and getting the compensation you are due.

I am unable to identify your case from the information contained in your review and so cannot comment on the individual circumstances of your case. However, I can confirm that our Aviation scheme is currently managing a higher volume of cases and a number of the timelines outlined in the Scheme Rules have had to be temporarily extended. We have highlighted this on our website and also inform customers of this once their case has been received. Rest assured that all cases will still be completed within 90 days of receipt of the complete case file, which is what is required under The Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015.

CEDR is not fit for purpose, let's get it shut down!

I have already documented my own experiences with CEDR on Trustpilot, reading the other negative reviews from claimants there is a clear pattern. CEDR all too often ignore evidence submitted by a claimant and side with the defendant. The defendants are companies and organizations who fund CEDR so it wouldn't be in CEDR's financial interest to uphold too many claims. Furthermore CEDR provides adjudication training, another source of income, and course trainees go on to act as adjudicators. Although they are not directly employed by CEDR they are clearly stakeholders so it is telling that the vast majority of five star Trustpilot reviews are from course attendees, not claimants. According to Trustpilot CEDR actively seeks reviews which supposedly adds credence to the overall score. They never asked me to leave a review, I would wager that the only people they do ask are the trainee arbitrators as they know these will be glowing reviews.
Did you know that CEDR is a registered charity? That means they avoid paying tax. Their accounts are readily available, they have 88 employees and 9 trustees. In year ending 31/3/23 their total income was £10,131,000. Eleven employees received benefits over £60,000, of those 2 received over £100,000, 1 over £140,000, 2 over £150,000 and one hit the jackpot receiving between £200,000 and £250,000. Of the trustees, one or more are directors of subsidiaries and one or more receive payments or benefits from the charity for services provided.
If you are claimant and have concerns about the outcome of your case and about the way CEDR is run you can complain to the Charity Commission and to the Trading Standards Institute.
Edit 26/11. CEDR are obviously rattled by all the bad reviews from claimants. Looks like they are getting desperate - manipulating the overall rating by getting more trainee adjudicators to leave 5 star reviews (3 in the space of an hour). Trustpilot take note!
