“Apparel Branders” will rip you off

“Apparel Branders” also “DBA Euphoric Colors” and “In LA Apparel” was contracted for the production of drawstring bed sheets late 2024. A sample was expected for approval. When it was late, my inquiry found that the production was almost done. The sheets are unusable. Patterns for the sheets were transmitted with 6% shrinkage compensation using digital drawing files with the correct dimensions digitally linked to the elements in the file providing two levels of verifiable specification. The sheets are 15% oversized 9% beyond the shrinkage compensation.

Defects include:
- Sheet size 9% oversized after shrinking leaving 5 inches of extra fabric in length and width.
- Drawstring not cut correctly so it was spliced with knots instead of buying additional string
- Stiffener used is not dryer safe, deforming under heat and remaining deformed.
- Changes to insert card for the package not approved.
- Changes to warning tag not approved.

The owner insists the sheets are per specification, denies liability. Has admitted, via email, that they sent no sample and went to production without approval. From the owner:

“I understand you're frustrated with the outcome, and I’m not dismissing your feedback—on the sizing, the hem stiffener, the cording, the graphic insert, and the labels. These are real concerns. But again, we followed the pattern and direction you provided. No corners were cut, and we never intended to bypass your approval. It was about getting the product done for you efficiently.”

The owner threatened to charge for storage and interest on delayed payment of the balance after the production was found unusable. He also sent a link to the profile of his sister who is a lawyer as an attempt to intimidate and said I would hear from his legal department. He later withdrew the threats and demanded that I not contact his sister/lawyer since it was a bluff. I didn’t hear from his legal department and still have not heard from them. Total loss $26,609.

The whole problem could have been avoided by simply sending a sample of what they were making. It was all their fault and they refuse to compensate my business for their blunder.

In Google Reviews the owner claimed they only charged a small deposit. That is a lie. They charged $10,000 and I supplied the fabric. That's about $21,000 up front cost. Then he went on to blame the disastrous result on "a business plan that unfortunately did not work as intended". I have no idea what was meant by business plan not working.
