My Mrs was looking for a Ford Focus…
My Mrs was looking for a Ford Focus Titanium Navigator for a while,I seen one advertised with Hillview Motors Newry. It was a Friday afternoon,I phone Killian about it & he was helpful & pleasant.I told him we would be driving from Coleraine to see the car(180 mile round trip). We went to see the car, took it a test drive & my Mrs liked it & wanted to buy it,though it had no SD card for the Sat Nav & 2 back tyres were wearing thin, but she liked it so bought it.She paid £5900 which she had saved hard to build up for the car with 68981miles on it with her debit card,we sorted out insurance, filled the tank with fuel & drove the car home.In the evening I was out in the car and found an MOT certificate from 2 years previous which stated that in 2019 the car had 94764 miles on it and in 2018 it had 76177 miles on it.I contacted Killian straight away and told him what I discovered,he said he knew nothing about this but he would look into it,we were absolutely gutted. We valued the car on Autotrader with the mileage that we suspect it has on it which was at least 110p00 miles and they valued the car at £4160-£4590,so up to £1740 lower than what we had paid!On the Saturday morning I contacted Killian again.I told him the Mrs thought about it & she liked the car and she needed the car for our autistic son and wanted to keep it regardless if he refunded the price difference. His reply was 'No problem I’ll give you a phone on Monday Davey.'As far as we were concerned after this comment she was keeping the car so we took the car & got the 2 tyres changed & we ordered an SD card for the Sat Nav.On Monday morning we taxed the car.I then contacted Killian & he told me that those 2 years mileage were input by the MOT centre by mistake in miles instead of km.He says they might be able to rectify it with the DVA.I contacted my local MOT centre & they said it sounds fishy & to contact DVA customer services, which I did.DVA told me that it was highly unlikely for it to be a mistake & even less likely for it to be a mistake 2 years running.Killian sent me a screenshot of an HPI check that he did on the car which he says showed it was clear. However, this check actually showed up another mileage discrepancy. On 21/07/15 it had 28558 miles & on 09/02/16 it had dropped to 22175 miles. So actually the car had been clocked twice!Despite this,my Mrs was still happy to keep the car to save us any hassle so long as the price difference was refunded & we would get the timing belt & water-pump changed ourselves.Though now that Killian knew that we wanted to keep the car to save any hassle, he said the only way he would sort it out would be if we gave up the car & he would refund us.We told him that we didn't want to do this because of the additional money she had spent on the car and she was happy with the car,she just wasn't happy with the price she paid for it.Killian has been consistently insisting the car be returned to him for a refund. He says the law states we can ask him for the difference in price to be refunded but he doesn't have to do this. Why would he not want to do this? The car cant be sold for any more than £4590 unless it is sold illegally by not informing the buyer of the mileage discrepancies,so why not just refund the difference to us?We have gave Killian the option of making us an offer of what he would give us back so we can move on and forget about the whole thing. But still he insists that the car be returned.I think we have been extremely fair with this,& what the law states he has to do,is not necessarily the morally right thing to do.We have done no wrong here, yet we are being made feel as though we are in the wrong. When I first met Killian I thought he was a nice, decent chap.I trusted him,his reviews were 5 star,he says this is the first time this has ever happened, its the first time it has ever happened to us,however,if this is the first problem he has ever had,& it was an honest and genuine mistake, youd think that hed want to sort it out amicably as we do.So just be careful if you have a problem you too might be treated diabolically!
